The National Investigation Agency (NIA) is preparing to send a court summons to Lashkar-e-Taiba chief Hafiz Saeed in connection with the Pahalgam terror attack case, with the notice to be sent to Pakistan through the Ministry of External Affairs.
Saeed has been named as an accused in the supplementary chargesheet filed by the NIA in the case. The Jammu NIA Special Court has already issued a non-bailable warrant against him.
Summons to Be Sent Through Ministry of External Affairs
As Hafiz Saeed is an accused in the case, the court summons will require him to appear during the trial proceedings.
According to the NIA, the process of serving the summons in Pakistan will be taken forward through the Ministry of External Affairs.
Trial May Proceed in Saeed's Absence
The NIA is also preparing to proceed with the trial in the Pahalgam terror attack case in Hafiz Saeed's absence.
For this, the agency will follow the ‘Trial of Absentia’ procedure under Section 365 of the BNSS-2023. The provision allows court proceedings to continue even when the accused is not present.
