Supreme Court Criticizes Ayurvedic Doctor and Hospital for Neglecting Rape Victim

On Friday, the Supreme Court expressed strong disapproval towards an Ayurvedic doctor and a private hospital in Ghaziabad, Uttar Pradesh. They are accused of failing to provide medical assistance to a four-year-old girl who was a victim of rape. The court raised concerns about whether the child was overlooked due to her family's impoverished status. A three-judge bench, comprising Chief Justice of India (CJI) D.Y. Chandrachud, Justice Joymalya Bagchi, and Justice V. Mohan, questioned the sensitivity of the doctor and the hospital, directing them to consider compensating the affected family.


Concerns Over Medical Ethics

According to reports from legal news sources, the bench stated, "If you cannot fulfill your duties, you have no right to call yourself a 'doctor'! If you had any sensitivity, you would have taken the child to another hospital despite the lack of facilities... Did you ignore her because she was poor? Because she couldn't pay your fees?" The Supreme Court was hearing a petition filed by the child's father, which alleged serious deficiencies in the investigation and medical assistance following the incident that occurred in March this year. The Ayurvedic doctor faced criticism for allegedly refusing to provide initial medical help to the child.


Harsh Critique of Hospital's Conduct

The Chief Justice remarked to the doctor, "A child was brought to you, and you were so callous that you did not provide her with medical assistance. If you had even a shred of compassion, you would have taken her to the hospital yourself." The bench also harshly criticized the private hospital where the child was taken, stating that the hospital's conduct was "extremely callous."
