Supreme Court’s ban on Namaz in Bhojshala premises continues, instructions to state government to provide a new place near the premises

New Delhi. The Supreme Court on Tuesday heard the petitions filed by various Muslim parties against the decision of Madhya Pradesh High Court on the Bhojshala case. The bench of Chief Justice Surya Kant, Justice Joymalya Bagchi and Justice V Mohana refused to issue any interim order on the petitions at present. Also refused to restore the situation before the High Court decision. Due to which the ban on Namaz in the Bhojshala premises will continue. The Supreme Court issued notice to the Central Government, Archaeological Survey of India (ASI), Hindu Front for Justice and other Hindu parties.

What instructions did the court give?

The bench, however, directed the state government to provide a separate space to the Muslim side near the Bhojshala, where Muslims can offer namaz between 1 pm and 3 pm on Friday. The bench made it clear that this direction is temporary till the final decision. Accepting the plea of ​​Muslim side’s lawyer Huzaifa Ahmadi, the bench directed that the ASI will not make structural changes in the Bhojshala complex without the approval of the court.

The court also said that the matter will be listed for final hearing soon. The bench said that they can hold the final hearing on this matter in the third week of July. During the hearing, Muslim side’s lawyer Huzaifa Ahmadi said that the High Court did not even give them a chance to appeal in the Supreme Court. In the year 2003, ASI had ordered that Namaz would be offered once a week on Friday and puja would be done once on Tuesday. Today we have been completely thrown out? This is very wrong.

The lawyer for the Muslim side said that the people who reported the ASI were not even interrogated. Huzaifa demanded a stay on the High Court order. Senior lawyer Singhvi said that there may be temples at some places, but there is no need to go back in history. Singhvi said, Namaz has been taking place here for 700 years. In the survey of 1927-28 it was said that this is a mosque. The notification of MP Waqf Act also says the same. Since 1977, Basant Panchami puja is also being performed here along with Namaz, but the order was passed on the writ petition of the Hindu side.

What did the Solicitor General say?

On this, Solicitor General Tushar Mehta, representing the government, opposed the Namaz in Bhojshala Complex and said that two months have passed since the order was given. A lot has happened. If instructions for prayers are given again, it may cause administrative problems.

CJI Surya Kant said that this is a very sensitive issue. There is a need to proceed and comment very thoughtfully, otherwise a wrong message will be sent to the public and there will be a wrong impact. It would be better if we fix it for hearing on a convenient date within the next 10-20 days.

CJI said that we should be very careful. Such an order should not be passed which will impact law and order. Despite the arrangements made by ASI, there have been problems there. This is a matter where both parties must be patient. This may take two to three weeks. Everyone should be prepared. Let us tell you that on May 15, 2026, the Indore Bench of Madhya Pradesh High Court had given its verdict in favor of Hindus by declaring the historical Bhojshala Complex of Dhar as the ancient temple of Mother Vagdevi (Saraswati).
