There is good news for businesses and micro, small and medium enterprises (MSMEs) in the country. Government has taken a significant step to promote ease of doing business. On Monday, the Department of Consumer Affairs announced the implementation of a new system of ‘Improvement Notices’ under the Legal Metrology Act, 2009. This new rule simply means, “Correct the mistake first, deal with the action later.” The change has been implemented by the Public Trustees (Amendment of Provisions) Act, 2026, so that businesses do not face direct penalties or legal difficulties for inadvertent procedural errors.

What is it exactly?

Hitherto, direct penal action was taken for even minor violations of the rules. But under the new mechanism, if a legal metrology officer finds a procedural or regulatory lapse for the first time, instead of taking direct action, he will issue a ‘correction notice’. This notice will clearly state the error and give the business a reasonable time to correct it. If the organization complies within the prescribed time, it can avoid penal action altogether.

Which industries and businesses will directly benefit from this decision?

The amendment applies to a number of market components, including mainly the following:

  • Manufacturer and Importer
  • Packagers and distributors
  • Repairers and General Traders
  • Micro, Small and Medium Enterprises (MSMEs) and other regulated entities
  • Among the first mistakes that lead to this suggestion are registration, documentation, model approval, manufacturing of weighing and measuring equipment
  • and includes sales, transactions to packaged goods and statutory information.

Whether this relaxation in rules will infringe on consumer rights is a fair question, but the department has clarified that the new system will not weaken consumer protection in any way, nor will there be any laxity in enforcement.

According to a statement from the department, “If anyone does not comply with the ‘correction notice’ or repeatedly ignores the rules, strict action will be taken as per the provisions of the Legal Metrology Act.” Moreover, no relief will be shown in respect of fraud, manipulation and other acts detrimental to the interests of consumers.
