Employees' Provident Fund Organization (EPFO) has recently issued updated guidelines regarding Digital Signature Certificates (DSC) and E-Sign Requests submitted by employers/organizations. These guidelines issued by EPFO ​​aim to improve security, streamline authentication processes and ensure compliance.

 

EPFO Digital Signature Certificates

- It may be noted that the use of DSC has already been made mandatory by the earlier circulars of the Central PF Commissioner.

 

 

- These circulars state that at least one DSC from the employer / company or an authorized signatory is required to be registered with EPFO.

- Now, with the introduction of e-sign as part of the e-governance initiative, secure authentication becomes even more important.

- The guidelines emphasize the potential legal consequences of misuse.

- Therefore, it is necessary for employers / companies to strictly follow the outlined procedures.

- As part of e-Governance initiative, EPFO ​​allows use of e-sign for authentication of establishment related documents and submission of statutory returns related to ownership.

- This action recognizes the impact of DSC and e-sgn on all stakeholders.

Guidelines for companies

- To streamline this authentication process and facilitate smooth processing, employers / organizations should follow specific instructions while submitting online requests.

- Employers / companies have to submit online request letter through unified portal.

- This letter should have three specimen signatures of the person intended to sign it.

- An up-to-date Form 5A detailing the right is essential to process these claims. 

- Include signer's name and mobile number in it.

- DSC/E-Sign request letter should be on company letterhead.

- This should be countersigned and stamped by the employer.

- The request must be accompanied by a valid proof of identity such as Aadhaar card or UAN card.

- Field offices will verify the authenticity of Aadhaar details submitted using designated online tools.

- EPFO ​​says that requests should be processed within 15 working days.

In case of misuse of DSC or E-Sign, both the employer / company and their authorized representatives will share joint responsibility. It is important to note that compliance with these new guidelines is critical to avoid legal consequences.
