Over 70 people living in South Texas have sued Elon Musk’s space launch company SpaceX, alleging severe property damage due to rocket testing.
A suit has been filed in federal court in Brownsville, Texas. It alleges harm done by 11 Starship test flights of the company from April 2023 to October 2025. These launches and touchdowns are said to have caused deafening noise, strong vibrations, and powerful shock waves.
Residents living in the area report serious physical damage to their properties due to these launches. As per the complaint filed, the force generated by launches of these rockets is not something that any ordinary residential area can withstand.
The filing says that SpaceX repeatedly exposed surrounding areas to “extraordinary amounts of acoustic energy.” Simply put, the amount of sound waves and vibrations produced by the rockets had traveled to nearby areas, harming buildings.
These structures are located near SpaceX’s Starbase operations in Cameron County. The company has made this facility on the coast a huge rocket manufacturing and testing complex in recent years. Starbase is of vital importance for SpaceX and its ambitious plans for space exploration, including lunar and Martian expeditions.
Local Residents File Lawsuit Over SpaceX Launch Safety and “Conscious Indifference”
Indeed, the whole future of SpaceX is connected with the Starship. This vehicle stands about 400 feet high when combined with the Super Heavy booster. Its thrust is estimated at over 16 million pounds at liftoff. This makes the SpaceX rocket even twice as powerful as the Space Launch System used by NASA.
This is one of the reasons why the owners of the residential properties consider their safety threatened. In the lawsuit, the plaintiffs state that the excessive power of the vehicle needs to be studied and proper safety measures should be implemented. According to their claims, SpaceX did not carry out proper risk analysis before commencing its test launches from the facility.
Moreover, the plaintiffs note that the company was aware of these risks but decided to continue its operations regardless of that. As a result, SpaceX acted with “conscious indifference” regarding the safety of the local population and their property rights.
SpaceX has yet to file its official response to the case in court. The company has also been silent about the lawsuit, choosing not to issue any public comments on the matter. Therefore, several questions remain unanswered, among them what steps the company plans to take regarding the allegations.
SpaceX Faces Legal Battle Over Starship Launch Damages
According to legal experts, such lawsuits usually depend on evidence. Residents will have to prove that the rockets were indeed responsible for damaging their property. To do this, engineering studies, noise measurements, and assessments of structural integrity would be needed. In turn, SpaceX would likely claim that the damage could have occurred due to other reasons or that the company had met all necessary requirements.
At the same time, the case underscores an important point. With the growing popularity of private space agencies, more companies are beginning to establish themselves near civilian zones. While rocket launches create job opportunities and attract investments, they also pose certain risks, both in terms of noise levels and safety issues.
SpaceX has been at the forefront of quick testing techniques. The strategy involves launching rockets often to refine designs and lower expenses. This tactic has made SpaceX progress more quickly than most projects. However, it comes with environmental consequences and impacts on nearby residents.
A win for the plaintiffs might become a standard-setting case. The court’s decision might cause SpaceX to adhere to more stringent guidelines for its next launches. Other players in the aerospace industry will have to be careful when designing and testing powerful rockets in residential areas.
For the moment, the case titled Jazmin Aguilar et al. v. Space Exploration Technologies is pending at the United States District Court for the Southern District of Texas. SpaceX hasn’t made any official response to the court.
The trial might not proceed fast. However, the people’s message is loud and clear. They want to see responsibility taken for the effects of powerful rockets launched in their vicinity.
