Madhya Pradesh Government has implemented a new procedure for petrol, diesel and CNG pump operators to resolve tax assessment cases pending in the financial year 2024-25. If the application is not sent by any means within 30 days, the application will automatically be considered accepted and the relevant line will be deemed to have been evaluated.
2024-25 Tax assessment based on self declaration in pending cases
The Commercial Tax Department of Madhya Pradesh has released the notification regarding the pending tax assessment cases of petrol, diesel and CNG pump operators. According to this, in eligible cases of financial year 2024-25, tax assessment will be considered completed through self-declaration based on the information provided by the businessmen.
This practice is applicable to the cases pending under Madhya Pradesh VAT Act 2002, Central Sales Tax Act 1956, Motor Spirit Excise Act 2018 and High Speed Diesel Excise Act 2018. After applying in the prescribed manner, the department will complete the tax assessment based on the available information.
Which pump operators will get this facility?
In Madhya Pradesh, this facility will be available to registered petrol pump operators who have purchased petrol, diesel or CNG from notified oil companies or registered traders paying tax and taxes. Moreover, there should be no tax filing case against them in the 2024-25 financial year.
Therefore, there should be no pending action in compliance with the pending notices regarding additional tax or audit. Those who have submitted refund requests for the relevant year are not eligible for this facility.
Necessary documents must be submitted along with the application
Pump operators must submit a certificate of payment of tax and interest along with the application. Businessmen with business transactions of more than Rs 2 crore must also submit a CA audit report.
Businessmen who have availed the benefits of CST exemption or concessional rate should also submit original documents including Form-C, F, E along with the application. Based on these documents and available information, the department will examine the application.
Opportunity for correction and investigation if error is found
If any defect or mistake is found while examining the application, the concerned authority will issue a written notice. The pump operator will then be given the opportunity to present his case and make necessary amendments.
The application can be accepted if the defects are rectified within the stipulated time. The application may be rejected in the following circumstances:

Under the new procedure, a deadline has been set for the department. If any application is not sent within 30 days from the date of submission, the application is automatically deemed to have been accepted.
This procedure has been implemented to resolve eligible pending cases to the 2024-25 financial year. However, this facility will not be available to traders who do not follow the prescribed procedure in cases to tax return, additional tax demand or audit.
No facility for cases involving tax refund and refund request
Cases detected in tax liability in the 2024-25 financial year are excluded from this facility. After notice is issued regarding additional tax demand, the traders who do not comply with it will not be able to get the benefits under this procedure.
Similarly, petrol, diesel and CNG pump operators who do not comply with the notes issued after tax audit and have submitted refund requests under the law in the relevant year are also ineligible for this facility.
