OpenAI's troubles increase, Apple opposes dismissal of case in court

Desk: The legal battle between Apple and OpenAI regarding trade secrets has escalated further. Apple has appealed to the court to reject the demand of OpenAI, in which the company had demanded to end the case at the initial stage itself. Apple alleges that OpenAI misused its trade secret information. Now the next big hearing in this case is to be held on 1 October 2026.

In its latest court filing, Apple has opposed OpenAI's demand to dismiss the case. According to Apple, this request of OpenAI is based on misrepresentation of facts, improper use of external evidence and speculation. The company has reiterated its allegations, saying that it has evidence of misuse of trade secrets and that OpenAI allegedly encouraged it. Apple also alleged that people associated with the company told some Apple employees how to obtain information.

    Apple had started a lawsuit against OpenAI for misuse of trade secrets. After this, OpenAI applied in the court on August 5, 2026 to dismiss the case. OpenAI's argument was that it did not need Apple's proprietary information and Apple itself was not capable of competing with it. Apple has now rejected OpenAI's argument and said that the company is presenting its allegations as simple mistakes or unintentional incidents.

    In this case, OpenAI has to file its reply to Apple's protest by 26 August 2026. After this, on October 1, 2026, US District Judge Edward J. Davila will hear arguments on OpenAI's demand to dismiss the case. If the judge rejects OpenAI's demand, the case could proceed to the discovery stage. In this process, both the companies can ask for documents, evidence, conversations and other information to the case. In this, records to OpenAI's hardware project, appointment of former Apple employees and the information that came with them may also be revealed.
