A special court in Nashik, Maharashtra, has granted bail to Nida Khan, the main accused in a high-profile conversion case linked to an IT company. This ruling has sparked considerable discussion in legal and social circles, particularly because the presiding judge referenced the historical tale of Lord Krishna's birth while delivering the verdict. Notably, Khan is currently five months pregnant.
Allegations Against Nida Khan
Nida Khan faces accusations of exerting mental and religious pressure on a female colleague to convert to Islam. She allegedly provided her with a burqa and religious texts, and assisted in installing religious applications on her mobile device. Additionally, she has been accused of making derogatory remarks about Hindu deities. Following the filing of an FIR at the Deolali Camp police station, she was arrested approximately two months ago.
Judge's Reference to Lord Krishna
During the bail hearing this week, Special Judge K.G. Joshi mentioned the birth of Lord Krishna in jail, emphasizing that no child should have to endure the trauma or social stigma associated with being born in prison. The court stated, "It is undisputed that the petitioner, Nida, is five months pregnant. Like Lord Krishna, no child should suffer the shock or social stigma of being born in jail. To avoid such a tragic situation and to ensure the well-being of the newborn, it would be appropriate to exercise judicial discretion in favor of the petitioner-accused."
Investigation Status
The court also noted that the investigation into the case has been completed, and a charge sheet has already been filed. Unlike other accused individuals, only one charge sheet has been submitted against Nida Khan in the case registered at the Deolali Camp police station.
Other Accused in the Case
In contrast, seven other accused individuals are facing a total of nine FIRs filed between March 26 and April 3. Investigators allege that Nida Khan distributed burqas and religious texts to her colleagues and assisted them in installing religious applications on their phones as part of efforts to promote conversion.
Public Attention on Bail Order
The bail order has attracted public attention due to the allegations against Nida Khan regarding derogatory comments about Hindu deities. According to the FIR, she also made offensive remarks about Lord Krishna. In this context, the judge's reference to the story of Krishna's birth during the bail decision adds a unique dimension to the ruling. It is important to note that the court made this reference in the context of protecting the unborn child's welfare and exercising judicial discretion, not as a judgment on the truth of the allegations, which are yet to be tried.
Legal Implications of the Bail Order
Receiving bail does not determine the guilt or innocence of the accused. It is a judicial decision based on various factors, including the stage of the investigation, the nature of the charges, the potential for evidence tampering, humanitarian grounds, and other legal principles. The trial will continue, and the allegations against the accused will be examined based on the evidence presented in court.
