Indian cricketer Abhishek Sharma has filed a petition in the Delhi High Court regarding the protection of his personality rights. In fact, he has demanded from the court that instructions should be given to remove the AI content and allegedly defamatory material created without his consent from the social media platform. However, during the initial hearing, the court found that the documents attached with the petition were not completely arranged, hence no interim order was issued at present.
During the hearing, the court has also said that it is necessary to have a clear record of facts in cases to personality rights and defamation on digital platforms. For this reason, Abhishek Sharma has been asked to re-submit all the relevant screenshots and links in a sequential manner.
Know what the High Court said in this matter?
Actually the case was heard in the court of Justice Jyoti Singh. The court observed that there was no complete similarity between the URLs and social media links mentioned in the petition and the screenshots in the affidavit. The court considered this deficiency serious and said that any kind of order can be given only after the records are clear. During the hearing, the court also said that in today’s digital era, there is a very thin line between personality rights and defamation cases. In such cases the court has to carefully examine every document and digital record. The court directed the counsel appearing for Abhishek Sharma to file all the screenshots, URLs and documents in the correct order along with the fresh affidavit. Only after this will further action be considered in the next hearing of the case.
The matter is to AI post
In the petition, Abhishek Sharma has claimed that using his name and picture on social media, such content was created with the help of AI, which affected his image. His lawyer told the court that in a post his manager had been described as his girlfriend, which he termed as false and misleading. On this basis, a demand has been made to remove the content. However, during the hearing, the counsel appearing for Meta Platforms told the court that out of the eight URLs given in the petition, two links were not available and could not be opened. At present, the court has not issued instructions to any social media platform to remove content.
