Supreme Court rejects Meenakshi Natarajan’s petition, refuses to interfere

SC setback for Congress: The Supreme Court has rejected the petition filed against the decision to cancel the Rajya Sabha nomination of Congress leader Meenakshi Natarajan. The court has clearly refused to interfere in the interim phase of this election process. The bench of judges made it clear that once the nomination is rejected, its appropriate legal remedy can only be possible through an election petition.

Reason for rejection of nomination

The nomination of Congress’s only Rajya Sabha candidate from Madhya Pradesh, Meenakshi Natarajan, was canceled by election officer Arvind Sharma. Because he was accused of hiding information about a pending legal case in Telangana in the election affidavits. This complaint was made by BJP candidate Mahesh Kewat. However, senior counsel Abhishek Manu Singhvi, appearing for Meenakshi Natarajan, argued in the court that under the Representation of the People Act, it is necessary to disclose only those cases in which there is a provision of minimum punishment of two years or the court has taken cognizance. Natarajan had received only a notice and the court had not even taken cognizance of the matter. Therefore this was not a criminal case.

Questioning the maintainability of the petition, the court said that whether the decision is right or wrong, the court does not interfere at this stage after the election process has started. After this decision of the court, Congress is out of the field. Now the path has been completely cleared for Bharatiya Janata Party (BJP) candidates to be elected unopposed on all three Rajya Sabha seats of Madhya Pradesh.
