Nagpur Bench of Bombay High Court has given a very historic and big decision regarding marital life and working women. The court has said in clear words that if a husband asks his working wife to contribute to the household expenses or to contribute his salary, then it cannot be considered as any kind of cruelty or illegal demand by law.
The single bench of Justice Vrushali Joshi, hearing the matter seriously, rejected the FIR and the entire charge sheet lodged against a Nagpur resident and his elderly parents. Let us tell you that this entire case was registered at Mankapur Police Station in Nagpur. In this, a case was registered under Section 498-A and Section 504 of the IPC accusing the husband and his in-laws of harassing a married woman and deliberately humiliating her with the intention of disturbing the peace, which has now been completely canceled by the court.
What was the wife’s allegation and why was the case registered?
If we go to the root of this whole matter, the complainant wife is a government employee. While filing a complaint with the police, she had made very serious allegations against her husband and in-laws. The woman said that because she was working, she was allegedly not able to do the rest of the household work. Due to this, her in-laws and husband were constantly pressurizing her to hand over her entire salary to them. The woman had filed a case on the basis of mental and physical cruelty.
High Court examined the allegations and gave a big decision
When the case came up before the Nagpur Bench of the Bombay High Court, Justice Vrushali Joshi meticulously examined every aspect of the case, the allegations and the evidence presented. The court clearly stated that such claims made by the wife do not at all prove the essential and legal ingredients of ‘cruelty’ under matrimonial law. The court commented that the entire matter was actually the result of a complaint filed by the wife in anger after the bitterness in the marriage and the deterioration in their relationship, which has no legal substance.
