Delhi Court Denies Bail to Umar Khalid Amid Controversial Riot Case

New Delhi: A Delhi court has rejected the bail request of Umar Khalid, a former student of JNU, who is implicated in the riots that occurred in northeast Delhi in 2020. The court deemed the reasons presented for bail as insufficient.


During the hearing, Additional Sessions Judge Sameer Bajpai considered Khalid's plea for a temporary bail of 15 days to attend the Chehlum ceremony for his uncle and to assist his mother, who is scheduled for surgery.


The judge remarked, "The court believes that attending the Chehlum ceremony is not essential. The situation would be different if the deceased was someone with whom the applicant had a closer relationship."


The court pointed out that Khalid could have requested bail immediately following his uncle's passing if the bond was indeed significant.


"If the relationship was as close as claimed, the applicant would have sought release at the time of his uncle's death, not after a considerable delay. Thus, the court finds this justification lacking," the judge stated.


Special Public Prosecutor Anirudh Mishra opposed the bail, arguing that Khalid has five sisters and a father who can support his mother during her recovery.


"The surgery is minor, requiring only local anesthesia, so there is no necessity for the accused to be present," Mishra added.


Acknowledging the prosecution's arguments, the court noted that Khalid himself mentioned having five sisters and a father available to assist his mother.


"Moreover, as indicated by the prosecution, the procedure is straightforward, involving only the removal of lumps, and there appears to be no real need for the applicant's assistance," the court concluded while denying bail.


Khalid faces charges related to a conspiracy linked to the communal riots in February 2020, which resulted in 53 fatalities and over 700 injuries.


He was arrested on September 13, 2020, under the Unlawful Activities (Prevention) Act (UAPA) and various sections of the IPC.


His initial bail application was turned down on March 24, 2022, and the Delhi High Court upheld this decision on October 18 of the same year.


Other activists, including Sharjeel Imam, Khalid Saifi, and former AAP councillor Tahir Hussain, are also implicated in this extensive conspiracy case, which is under investigation by the Special Cell of the Delhi Police.
