Bail plea of ​​Delhi riots accused Umar Khalid rejected

Karkardooma Court of Delhi has refused to grant interim bail to accused Umar Khalid, who is in judicial custody in the 2020 Delhi riots conspiracy case. Umar Khalid had sought interim bail of 15 days to attend the Chehlum (religious ritual on the 40th day of his death) of his late maternal uncle and to take care of his mother during her upcoming surgery.

Umar Khalid had told in the court that his family consists of father, mother and five sisters. However, his 71-year-old father is not in a position to take care of his mother. Also, his four sisters are married and live at different places. In such a situation, being the eldest and only son of the family, it is necessary to take care of the mother before and after her surgery.

The petition also said that Umar Khalid had been granted interim bail several times in the past and every time he had surrendered on time following all the conditions of the court. His side also argued that the court had also granted interim bail to co-accused Taslim Ahmed, Shifa-ur-Rehman and Athar Khan on the grounds of reasons like family illness, hence under the principle of equality they should also get relief.

However, the special government pleader opposed the bail plea saying that the accused was trying to take advantage of the sympathy of the court. He said that earlier bail was granted on the basis of reasons which were considered appropriate, but this time the reasons presented are not sufficient.

The government side argued that maternal uncle’s Chehlum does not fall in the category of immediate family obligation and it is not mandatory to attend it, as other members of the family can also perform this ritual. At the same time, regarding the surgery of Umar Khalid’s mother, it was said that this is not a serious operation, but a normal procedure, in which only local anesthesia will be given. In such a situation, other family members can take care of them.

After reviewing the arguments of both the parties and the record, the court said that it is true that earlier interim bail was granted to Umar Khalid and other co-accused and they did not violate the conditions. But this does not mean that every time bail is sought, it should be approved.

The court made it clear that every new bail plea has to be evaluated on its own facts and circumstances and relief can be granted only if there is sufficient cause.

The court said that Umar Khalid had sought interim bail this time on two grounds. Firstly to attend his maternal uncle’s Chehlum and secondly, to take care of his mother during her surgery. However, considering these reasons not sufficient, the court rejected his interim bail plea.
