Delhi Court Denies Interim Bail to Umar Khalid in UAPA Case Related to 2020 Riots

A Delhi court has rejected Umar Khalid's plea for interim bail in connection with the UAPA case linked to the 2020 riots in Northeast Delhi. The additional sessions judge, Sameer Bajpai, dismissed Khalid's request, which sought 15 days of interim bail to attend the Chehlum ceremony following his uncle's death and for medical examinations related to his mother's surgery scheduled for June 2.


The court stated that the fact that Khalid and other accused had previously been granted interim bail without violating conditions does not imply that every bail request should be automatically approved. The judge remarked that attending the Chehlum ceremony was not of utmost importance, suggesting that if the relationship was indeed close, a bail request should have been made at the time of death rather than after a significant delay.


Regarding the surgery, the court noted that Khalid has other sisters who can care for their mother, and their father is also available for support. The Delhi Police opposed the interim bail application, arguing that Khalid's release could negatively impact public order and administration due to the case's sensitive nature and potential repercussions. They contended that the bail request was baseless and should be dismissed at this early stage, as no extraordinary or compelling circumstances justified granting interim bail.


The FIR against Khalid, numbered 59/2020, includes serious charges under various sections of the UAPA, including sections 13, 16, 17, and 18, as well as sections 25 and 27 of the Arms Act, and sections 3 and 4 of the Prevention of Damage to Public Property Act, 1984, along with other offenses under the Indian Penal Code, 1860. Other individuals charged in FIR 59/2020 include former AAP councillor Tahir Hussain, Jamia Coordination Committee members Safura Zargar, Meeran Haider, and Shifa-ur-Rehman, as well as activists Khalid Saifi, Shadab Ahmed, Tasleem Ahmed, Salim Malik, and Athar Khan. Subsequently, supplementary charges were filed against Umar Khalid and Sharjeel Imam.
