India Implements Major Reforms with New Labour Codes

After a prolonged wait, the Indian government has introduced substantial reforms in the country's labour framework by fully implementing four new labour codes. The necessary regulations have been published in the official gazette, making these laws effective immediately. The four new codes include the Wage Code 2019, Industrial Relations Code 2020, Social Security Code 2020, and the Occupational Safety, Health and Working Conditions Code 2020. The primary aim is to consolidate 29 outdated labour laws into a streamlined and modern system.


Abolition of 29 Old Laws

The government believes that the previous labour laws had become cumbersome over time, causing difficulties for both employers and employees. The new labour codes aim to simplify and enhance transparency within the system. This reform is intended not only to improve the ease of doing business but also to create new job opportunities and provide better security for every worker.


New Work Hours and Overtime Regulations

According to the new regulations, employees are now limited to a maximum of 48 working hours per week. This means that working hours will be capped, preventing excessive burdens on employees. If an employee works beyond the stipulated hours, they will receive full payment for overtime. Additionally, it is now mandatory to provide employees with at least one day of rest each week.


Mandatory Job Letters and Health Check-ups

A significant change in the new labour codes is the requirement for employers to provide a written appointment letter to every employee. This will enhance job transparency and strengthen employee rights. Furthermore, free health check-ups will be available for employees aged 40 and above.


Equal Pay and Opportunities for Women

The new regulations also include important provisions for women. Equal pay for equal work and equal opportunities will now be ensured. Additionally, women working in different shifts will also be granted equal rights.


Support for Reskilling After Job Loss

The government has also established a new National Reskilling Fund. This fund will be utilized to retrain employees who lose their jobs for any reason, helping them access new employment opportunities.


Enhancing Worker Security and Future Prospects

The new labour codes are viewed as a significant reform in India's labour system. They promise greater security and benefits for employees while simplifying regulations for companies. The government asserts that these changes will foster a pro-worker and pro-growth environment, strengthening both employment and the economy.
