Medical Store Rules: In today's times, medical stores or pharmacies have become an integral part of our daily lives. Due to a growing population and increased health awareness, the demand for medicines has risen rapidly. This is why many people view opening a medical store as a profitable business venture. However, it is crucial to understand that the pharmaceutical business is not like running an ordinary shop; rather, it is directly linked to people's health, and therefore, strict regulations have been established for it.
Can a Chemist Shop be Opened Using Someone Else's License?
In India, a medical store or chemist shop cannot be opened using another person's drug license. This is strictly illegal. Under the Drugs and Cosmetics Act, 1940, a drug license is non-transferable; this means that only the specific individual and the specific shop in whose name the license was issued are authorized to utilize it. Operating a shop using a license issued in someone else's name is considered a punishable legal offense.
Licensing Regulations
A drug license is always issued for a single, specific shop only. One cannot open two or more shops using a single license. If an individual attempts to do so, legal action may be initiated against them, and their license may even be revoked.
Furthermore, the presence of a registered pharmacist is mandatory at every medical store. This pharmacist must be recognized by the Pharmacy Council of India, and their name must be duly registered with the State Pharmacy Council. The sale of medicines must be conducted under their direct supervision.
Eligibility Criteria for Opening a Medical Store
To open a medical store, one is required to possess a degree in Pharmacy—specifically a Diploma in Pharmacy (D. Pharm) or a Bachelor of Pharmacy (B. Pharm). This degree must be obtained from a recognized educational institution. Without these qualifications, it is not possible to obtain a drug license.
What to Do If You Do Not Have a Degree?
Even if you do not hold a degree in Pharmacy, you can still open a medical store; however, to do so, you must hire a qualified and licensed pharmacist who is present at the shop throughout its operating hours.
Violating the Rules Can Prove Costly
Operating a shop under someone else's license, renting out a license, or opening multiple shops using a single license is illegal. Engaging in such practices may result in heavy fines, license cancellation, and legal action.
