On the question of Mamata Banerjee not resigning, Suvendu Adhikari said – ‘Everything is written in the Constitution, I do not need to say anything more’

Kolkata. The current Chief Minister of West Bengal Mamata Banerjee has given a big statement in a press conference on Tuesday after the assembly election results. He said that I have not lost in this election, hence there is no question of resigning from the post of Chief Minister. I will not resign. Let us tell you that in this press conference, Mamata Banerjee has openly accused the Commission of irregularities during the elections. He has also accused TMC of stealing votes. She says that she has not lost, she has been defeated. In such a situation, she will not resign from her post. Now a period of political rhetoric has started regarding his statement.

Senior BJP leader Suvendu Adhikari, who defeated Mamata Banerjee from Bhawanipur seat by a margin of more than 15 thousand votes, has reacted to her statement. He said that I do not know what she (Mamata Banerjee) is saying, but I would just say that everything is written in the Constitution. There is no need for me to say anything more than this.

What will happen if CM does not resign?

If a CM does not resign then the Governor has special powers. The Governor can first ask for resignation from the defeated CM and if he refuses, he can issue an order for immediate dissolution of the Assembly. In such a situation the Governor can dismiss the Chief Minister. If any step is taken by the Chief Minister or any major crisis arises, then the Governor can recommend President’s rule under Article 356. This happens in case of failure of the constitutional machinery in the states. However, in the case of West Bengal, the election results have come and it is clear whose government will be formed in the state.

How will the new government be formed?

The Governor has the power to appoint a new Chief Minister of the state and administer the oath under Article 164. After the government losing the elections and the dismissal of the CM, the Governor can choose the leader of the legislative party as the Chief Minister, after which a new government can be formed. This means that even if Mamata Banerjee does not resign, she cannot remain the CM of West Bengal after the mandate.
