‘No age to fight’, SC advises mother Rani in Sanjay Kapoor property dispute

A new incident has come to light in the property dispute to late businessman Sanjay Kapoor. On Monday, the Supreme Court issued notice on Rani Kapoor’s petition. Rani Kapoor is Sanjay Kapoor’s mother and she is 80 years old. Referring to his age in this case, the court said that this is not the age for fighting.

 

The court has sought answers from Sanjay’s wife Priya Sachdev Kapoor and 22 others. The court also said that mediation could be the best way to resolve this family dispute. According to news agency ANI, the bench of Justice JB Pardiwala and Justice Vijay Bishnoi made this comment.

 

Suggestion to resolve through mediation

The court said, ‘Why are you all fighting? You are 80 years old. This is not your age to fight. The bench further said that a prolonged court battle is not in anyone’s interest. The court clearly suggested, ‘Take the entire matter to mediation at once, from A to Z. Otherwise it is useless.

 

The court said that it would be in the interest of all the parties to resolve the dispute in a peaceful and fair manner through mediation. However, the court said that if needed, the case will be heard on merit, but mediation should be tried first. Now this matter will be listed again next week.

What is in Rani Kapoor’s petition?

Rani Kapoor has appealed to the court in her petition to stop others from interfering in property, assets and matters. He has also challenged some orders of the Delhi High Court. They say that the property was not properly secured and there is a danger of the assets getting dispersed.

 

Senior advocate Shyam Diwan argued in the court on behalf of Rani Kapoor. He said that in big property disputes, courts usually give protection orders at the initial stage.

What is the root of the dispute?

This dispute is to Rani Kapoor Family Trust. Rani Kapoor has challenged the formation of this trust. He alleges that the trust was created in such a way that he was stripped of control over his assets, including his stake in Sona Group.

 

Rani Kapoor said that she suffered a stroke in 2017. After that his son Sanjay and others transferred the property without his consent. This controversy increased further last year after the death of Sanjay Kapoor. Now many claims are being made on the family’s property and business.

The case is also going on in the High Court

Many cases to this matter are also going on in the Delhi High Court, including issues to the children of Sanjay Kapoor’s ex-wife, actress Karisma Kapoor.

 

Court’s message: The Supreme Court clearly said that family members should resolve the dispute peacefully. A prolonged fight will do no good, especially at the age of 80. Now it remains to be seen whether the family chooses the path of mediation or not.
