200 crore fraud case: ED asks for time on Jacqueline’s application, wants to become government witness

The Enforcement Directorate (ED) on Monday sought additional time to file its reply on Bollywood actress Jacqueline Fernandez’s plea in which she has expressed her desire to turn approver in the alleged Rs 200 crore money laundering case. This case is going on in the special court, which is being heard in the court of Special Judge Prashant Sharma. The court has fixed May 8 as the next date for further hearing in this case. Earlier, on April 17, the court had issued a notice to the ED on the application of the actress’ lawyer. Now the agency has asked for more time to reply, which the court accepted and scheduled the next hearing.

In this case, ED in its charge sheet has named Jacqueline Fernandes as a co-accused in the alleged cheating and money laundering case. This case is to the money laundering case of Rs 200 crore to swindler Sukesh Chandrashekhar. The investigating agency alleges that aspects to financial transactions and taking benefits are being investigated in this case, due to which the proceedings have been going on in the court for a long time. Important developments have already taken place at the judicial level in this case. On July 3 last year, the Delhi High Court had rejected his petition, demanding cancellation of the FIR registered by the ED. After this, within two months the Supreme Court also refused to interfere in the decision of the High Court. Currently the matter is under judicial process

Sukesh is in jail since October 2019

This case is part of a larger investigation to fraud and organized fraud, in which it is alleged that Sukesh Chandrashekhar cheated a huge amount of money by posing as a top government official. According to the information, Delhi Police had registered a case against him that he had defrauded the wives of former Ranbaxy promoters Shivinder Singh and Malvinder Singh of about Rs 200 crore. The background of this entire case is that Shivinder and Malvinder Singh are facing charges of fund diversion of about Rs 2,397 crore to Ranbaxy and they are in jail since October 2019. The allegation is also that Sukesh Chandrashekhar presented himself as a senior government official and carried out this fraud on the pretext of getting bail.

This case is part of a broader investigation into allegations that Sukesh Chandrashekhar operated a fraud and extortion network while inside jail. According to the investigating agencies, during this period he established contact with many people and also allegedly gave expensive gifts. Bollywood actress Jacqueline Fernandez’s name was also linked in this case, as it is alleged that she was also brought under the ambit of investigation due to the gifts and contacts given by Sukesh. In such cases, if an accused applies to become an “approver”, its legal effect entirely depends on the approval of the investigating agency and the court. Regarding the application pending before the ED in this case, it is being said that if it is accepted, Jacqueline Fernandez may get some legal benefits. In Indian law, a “government witness” is a person who gives inside information and evidence to the case to the investigating agency and cooperates against the main accused and is ready to testify in the court.

According to legal experts, cooperation may lead to remission or relief in punishment. In some cases, there is a possibility of leniency in the charges, but it entirely depends on the approval of the court and the quality of the evidence given. At present, she is facing proceedings as an accused in this case. If the application is accepted, their status may change from that of an accused to that of a government witness, but this does not happen automatically and requires a formal legal process.
