digital desk- Congress leader Pawan Kheda has received a big blow from the Supreme Court. The Supreme Court has currently stayed his anticipatory bail and asked him to approach the lower court of Assam for relief. After this decision, Kheda’s legal problems seem to be increasing. Actually, this case is to the FIR lodged by the wife of Assam Chief Minister Himanta Biswa Sarma. In this case, Kheda is accused of giving wrong and misleading information about the Chief Minister’s family in the press conference. A hearing in this matter was held in the Supreme Court on Wednesday. Justice J.K. A bench of Justice Maheshwari and Justice Atul S Chandurkar, while hearing the case, said that it is not appropriate to grant relief from the Supreme Court at this stage. The court clarified that the petitioner should first file his anticipatory bail application in the court having the relevant jurisdiction i.e. the court of Assam.
Case was registered on the complaint of Assam CM’s wife
Earlier, Telangana High Court had granted interim anticipatory bail of one week to Pawan Kheda. Kheda had approached the High Court on April 7, expressing fear of arrest and demanding transit bail. He had mentioned Hyderabad address in his application, on the basis of which he got temporary relief. The crux of the case lies with a press conference held on April 5, in which Pawan Khera had alleged that Chief Minister Himanta Biswa Sarma’s wife had multiple passports and properties abroad. He had also said that these properties were not disclosed in the election affidavit. This statement came at a time when preparations were going on for the assembly elections in Assam.
Sarma couple rejected Pawan Kheda’s allegations
However, the Sarma couple completely rejected these allegations and called them false and fabricated. After this, a case was registered against Kheda at Guwahati Crime Branch police station. A case has been registered in the FIR under sections 175 (false statement to elections), 35 and 318 (fraud) of the Indian Justice Code (BNS). Now after the latest instructions of the Supreme Court, Pawan Kheda will have to appeal for his anticipatory bail in the Assam court itself.
