The Supreme Court has issued notices to the Election Commission of India (ECI), the central government, and state authorities regarding a petition that seeks to implement a biometric identification system using fingerprints and iris scans to prevent re-voting at polling stations. This petition was filed by Ashwini Kumar Upadhyay, a leader and lawyer from the Bharatiya Janata Party (BJP). The notice was issued by a bench comprising Chief Justice of India (CJI) D.Y. Chandrachud and Justice Joymalya Bagchi. However, they clarified that the petition could not be considered in the context of the ongoing assembly elections in West Bengal, Tamil Nadu, Kerala, Assam, and the Union Territory of Puducherry.
Future Elections and Biometric Measures
The Supreme Court remarked that it is essential to assess whether such measures should be adopted before the next parliamentary elections or state assembly elections. During the hearing, the bench had initially directed the petitioner to approach the Election Commission, but after the petitioner clarified that the discussion was not about the ongoing assembly elections in four states and one Union Territory, the court agreed to hear the case. The court noted the necessity of investigating whether such protocols could be implemented for the upcoming parliamentary or state elections.
Election Dates and Concerns Raised
Voting in Assam, Kerala, and Puducherry took place on April 9 in a single phase, while Tamil Nadu's voting is scheduled for April 23. West Bengal will conduct voting in two phases on April 23 and April 29. The election commissions of all states will announce the results on May 4. Upadhyay, in his petition, expressed that the potential harm to citizens is significant due to issues like bribery, undue influence, impersonation, and fraudulent voting, which continue to undermine the integrity and sanctity of the electoral process.
