Impeachment Motion Against Chief Election Commissioner Dismissed by Parliament Leaders

Both the Chairman of the Rajya Sabha and the Speaker of the Lok Sabha have rejected the impeachment motion filed against Chief Election Commissioner Gyanesh Kumar after thorough discussions. Members were informed that a proposal, signed by 63 members of the Rajya Sabha, was presented on March 12, 2026, demanding Kumar's removal, citing Article 324(5) and Article 124(4) of the Indian Constitution, along with Section 11(2) of the Chief Election Commissioner and Other Election Commissioners (Appointment, Conditions of Service and Tenure) Act, 2023, and the Judges (Inquiry) Act, 1968.


Parliamentary Procedures Followed

After carefully evaluating all relevant aspects and issues, the Rajya Sabha Chairman exercised powers granted under Section 3 of the Judges (Inquiry) Act, 1968, to deny the acceptance of the proposal notice. The Lok Sabha Secretariat confirmed that a notice regarding the proposal, signed by 130 members of the Lok Sabha, was submitted to the Speaker, requesting the removal of Chief Election Commissioner Gyanesh Kumar.


Opposition's Allegations

The Secretariat stated that after proper deliberation on the proposal notice and a meticulous evaluation of all pertinent aspects, the Lok Sabha Speaker also declined to accept the notice using the powers conferred under Section 3 of the Judges (Inquiry) Act, 1968. Additionally, the Rajya Sabha Chairman, Radhakrishnan, dismissed the opposition's notice as well, as reported in a bulletin issued by the Rajya Sabha Secretariat. In their notice, 130 Lok Sabha and 63 Rajya Sabha opposition members accused Chief Election Commissioner Kumar of acting under the influence of the executive and alleged that he had deprived citizens of their voting rights through a Special Intensive Review (SIR) process.
